The Environment Canada “Challenge”

History

The Environment Canada “Challenge”-On December 8, 2006, Environment Canada and Health Canada announced a new Chemicals Management Plan. A key element in the Chemicals Management Plan is the collection of information on the characteristics and uses of the approximately 200 chemical substances identified. The substances were selected through a categorization process as high priority for action based on their harmful effect on human health and/or the environment. This information will be used to make decisions regarding the best approach to regulate the risks these substances might pose. This initiative, known as the "Challenge", was announced in a Notice published in the Canada Gazette entitled: Notice of intent to develop and implement measures to assess and manage the risks posed by certain substances to the health of Canadians and their environment. Under the Challenge, approximately 200 substances of highest priority have been divided into a number of smaller groups of substances (batches) to be addressed sequentially. The purpose of the Challenge is to asses if any facility used/imported/produced more than 100 kg of these substances in 2006.
Stakeholders and other interested persons had the opportunity to file comments with respect to the substances proposed for these future ‘batches’. Furthermore, industry and interested stakeholders were invited to submit any information that may be used to asses the risk posed by these substances and to develop best practices for risk management and product stewardship.

Schedule

In February 2007, the Government began releasing Notices in the Canada Gazette on the ‘batches’ identified under the Challenge. A ‘batch’ is released every three months.

The Notice regarding Batch 1 [13 substances, divided into 2 sections] was released on February 3, 2007. The Notice regarding Batch 2 [15 substances, divided into 2 sections] was released on May 12, 2007. The Notice regarding Batch 3 was released on August 20, 2007. On November 17, 2007, the Minister of the Environment and the Minister of Health released a Notice in the Canada Gazette for the fourth group of substances identified under the Challenge, entitled: Notice of fourth release of technical information relevant to substances identified in the Challenge (Batch 4 - 18 substances). The Batch 5 Notice was released on February 16, 2008 (19 substances). The Batch 6 Notice was released on May 31, 2008 (18 substances) and it has a dead-line established for September 30, 2008.
The proposed composition of the remaining upcoming batches of the Challenge (batches 7 through 12) was revised following the expiration of the public comment period. Moreover, industry and interested stakeholders are invited to submit a voluntary questionnaire about the scientific properties of these substances, or best practices for their use which might help improve decision-making. The scope of work for the completion of the Challenge requirements for a facility includes

1. Review Material Safety Data Sheets to identify materials containing substances listed under the Challenge.
2. Prepare List of Materials Containing Substances listed on each Batch.
3. Complete the Declaration of Stakeholders Interest for the facility if it meets
the criteria.
4. Complete the Declaration of Non-Engagement for the facility if it does
not meet the criteria.
5. Submit applicable forms to Environment Canada – The DSL Office.
